Right of withdrawal

Pursuant to the D.Lgs 206/2005 (Consumer Code), as amended by D.Lgs. n.21 of 21 February 2014, the Customer (if he/she qualifies as a "consumer") has the right to withdraw from the contract and return the products ordered, without any penalty and without specifying the reason, within 14 (fourteen) calendar days of receiving the products themselves.

The right of withdrawal referred to in the previous paragraph must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter a.r. at SUN FOODS S.R.L., Viale Affaccio, 38/44 - 89900 Vibo Valentia (VV) within 14 (14) calendar days of receiving the products. The above communication may also be sent, within the same timeframe, by telegram or fax to ALIMENTARI DEL SOLE S.R.L. to the number 0963 374807, provided it is confirmed by registered letter a.r., within 48 (forty-eight) hours of sending the telegram or fax.

All returns (which must be accompanied by the original packaging) must be authorized by ALIMENTARI DEL SOLE S.R.L. which will issue a Return Merchandise Authorization (RMA) number. Once the RMA number is received, the Customer may return the product at their own expense to the following address: ALIMENTARI DEL SOLE S.R.LViale Affaccio, 38/44 - 89900 Vibo Valentia (VV). Packages paid for with cash on delivery will not be accepted.

Damaged goods can also be returned (within the aforementioned deadline). In this case, ALIMENTARI DEL SOLE will: S.R.L. will retain the amount necessary to cover the damage.

Once the products have been received (and their integrity has been verified) ALIMENTARI DEL SOLE S.R.L. will credit the Customer for the cost of the returned products (as indicated on the invoice) as soon as possible, and in any case within 14 calendar days of receiving the goods.

In the event that the goods are damaged, a sum will be credited, deducted from the cost of the damage.

The right of withdrawal does not apply to Customers who purchase for purposes related to their business activity (e.g. instrumental use, resale, etc.) and who therefore communicate to ALIMENTARI DEL SOLE S.R.L. your VAT number.

The right of withdrawal is finally excluded in the following cases:

• Purchase of packaged products, whose original packaging has been tampered with or damaged by the Customer;
• Purchase of items made to measure or clearly personalized or which, by their nature, cannot be returned or which are liable to deteriorate or expire rapidly.

Applicable laws

Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Articles 50 to 68 ("distance contracts") of the D.Lgs 206/2005), any dispute in any way connected to these General Conditions will be devolved to the exclusive jurisdiction of the Court of Vibo Valentia.

Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and specifically accept the following clauses of the ALIMENTARI DEL SOLE General Conditions of Sale S.R.L.
